The Scale of the Shift
Coinbase’s AgentKit, launched in late 2024, made it trivial for developers to create agents with embedded wallets. By Q1 2026, AgentKit-based agents and Fetch.ai’s agent marketplace collectively account for over 60% of all agent wallet creation. The barrier to deploying an autonomous onchain agent dropped from months of custom development to hours of API integration.
The result is a new class of market participant that operates at machine speed, across time zones, without fatigue, and with no inherent legal personhood. Financial regulators were not designed for this.
The Liability Gap
When a human trader loses money on a DeFi protocol, the legal landscape is reasonably clear: the human bears the loss, the protocol may or may not have disclosed risks, and existing frameworks for financial loss apply. When an AI agent loses money, none of that is clear.
The deployer of the agent is the most obvious candidate for liability. But deployers frequently use third-party agent frameworks, run on infrastructure they do not control, and interact with protocols that explicitly disclaim responsibility for autonomous interactions. Contract law has not caught up with multi-party agent deployment chains.
The IRS issued preliminary guidance in January 2026 treating AI agent transactions as taxable events attributable to the human deployer. That resolves one narrow question. It does not resolve what happens when an agent is exploited, when it executes an unauthorized transaction due to a prompt injection attack, or when it causes losses to a counterparty through autonomous arbitrage.
What Protocols Are Doing
Several major DeFi protocols updated their terms of service in late 2025 and early 2026 to explicitly address AI agent interactions. Uniswap’s updated terms, published in November 2025, state that agents interacting with the protocol do so at the risk of the deployer. Aave’s governance forum has an active proposal to implement agent authentication requirements before high-value transactions are processed.

The lack of a standard is creating compliance complexity for developers who want to deploy agents across multiple protocols without bespoke legal review for each integration.
The Insurance Gap
Institutional adoption of AI agents for treasury management and DeFi yield strategies is being held back by one practical problem: no major insurer currently offers coverage for AI agent-initiated crypto losses. Lloyd’s of London has a working group examining the category. No product has shipped.
Without insurance, any institution that deploys an AI agent with material funds is accepting unhedged operational risk. That is a non-starter for most treasury managers operating under fiduciary obligations. The insurance gap will constrain institutional adoption more than any regulatory guidance will in the near term.
The agent economy is not just changing how crypto is used. AI tools are reshaping how crypto developers work too, with measurable effects on the metrics the industry uses to track ecosystem health.
The TCB View
The technology is moving faster than every legal and insurance framework designed to contain it. That is not new in crypto. What is new is the scale and the stakes. An AI agent that autonomously manages $10 million in DeFi positions is not a curiosity. It is a systemic risk vector that no regulator has a clear mandate to address.
The deployer liability framework that is emerging by default is the right instinct but the wrong implementation. Deployers cannot reasonably be held responsible for every downstream consequence of an agent that interacts with dozens of protocols, responds to real-time market conditions, and executes thousands of transactions. The legal system needs to develop a doctrine for agent liability that distributes responsibility proportionally across the deployment chain.
Until that doctrine exists, the safest position for institutions is to treat AI agent deployment as they would any other uninsured operational risk: limit exposure, document everything, and assume the legal framework will catch up eventually. It always does. The question is whether it catches up before or after a significant incident forces the issue.
